Article 377: Why its abrogation should vest with Parliament, not the courts

As is appropriate for our time, this piece developed from a conversation on the repeal of Article 377 on Twitter. In the fiercely contested world of Indian Twitter, my interlocutor is on my side of the debate—she supports a secular, liberal world view and argues against majoritarian excesses. Further, from what I have seen, she seems animated only by the warmest of human instincts.

But lacking such character and burdened with a life-long distrust of moral fervour, I found myself in deep disagreement with her arguments. At issue was not whether Article 377 ought to be repealed—both my interlocutor and I feel that it should. Rather, at issue was whether it ought to be repealed by the courts or by Parliament. I feel that the repeal of Article 377 is properly the prerogative of Parliament, not of the courts.

Perhaps it is just a matter of age. Young progressives see the decriminalisation of homosexuality as an entitlement. I see it, as I do all personal law, as a matter that needs to be negotiated with society. Social norms—birth, marriage, death, inheritance—from which personal law flows are not immutable truths. They evolve, as society does, with technology, trade and travel. Each age has its definitions of normal and deviant. I do not suggest that these definitions are necessarily fair or equitable. Only that arriving at these are legitimate matters of public debate and contest. A century back, child marriage was the norm, gay marriage unthinkable. Perhaps inconceivably to someone in the 1920s, our norms today have flipped. Similarly we can only imagine the customs of the future. But just as we don’t want to be shackled by laws that reflect that mores of an age past, nor would the generations who succeed us.

Twitter suspends blue check mark verifications after Jason Kessler backlash

Twitter

Twitter has suspended its account verification exercise -- a process that gives public figures on the micro-blogging platform a blue check mark next to their names.

The announcement came after people criticised Twitter for verifying the account belonging to the organiser of the white supremacist rally in Charlottesville, Virginia, that left one dead in August, TechCrunch reported on Friday.

"Verification was meant to authenticate identity and voice but it is interpreted as an endorsement or an indicator of importance.

"We recognise that we have created this confusion and need to resolve it. We have paused all general verifications while we work and will report back soon," read a tweet from @TwitterSupport account.

Jason Kessler, the organiser of the supremacist rally, was given the preferred status indicated by the blue badge.

Twitter had earlier withheld blue check mark for whistleblower Julian Assange.

"We should've communicated faster on this: our agents have been following our verification policy correctly, but we realised some time ago the system is broken and needs to be reconsidered.

"And we failed by not doing anything about it. Working now to fix faster," tweeted CEO Jack Dorsey.

Launched in 2016, the micro-blogging website created an online application process for Twitter accounts to receive verified status, which allows people to identify key individuals and organisations on Twitter as authentic and are denoted by a blue tick icon.

This typically includes accounts maintained by public figures and organisations in music, TV, film, fashion, government, politics, religion, media, sports, business and other key interest areas.

Morning Azaan disturbed his sleep and Sonu Nigam went on a rant

Sonu Nigam

Not everyone is having a great start to the week this Monday it seems. Sonu Nigam sure is one person who is not happy with being woken up early by loudspeakersblaring the Azaan from a mosque and his tweet has created the proverbial storm in the Indian Twitter cup.

At 5:25 am today morning, Sonu tweeted

God bless everyone. I'm not a Muslim and I have to be woken up by the Azaan in the morning. When will this forced religiousness end in India

At last count the Tweet had been retweeted more than 2100 times and Twitter can’t stop dissing the use of loudspeakers at Mosques, Temples or for any religious function

But Sonu Nigam didn't just stop there

And by the way Mohammed did not have electricity when he made Islam.. Why do I have to have this cacophony after Edison?

And no, he didn’t just single out Mosques for using loudspeakers

I don't believe in any temple or gurudwara using electricity To wake up people who don't follow the religion . Why then..? Honest? True?

While some took offence at his tweets, others added that loudspeakers at all religious places were a problem and ought to be shut down.

Don't want to hear the Azaan at dawn, nor do I want to hear a Chikni Chameli tuned Ganesh Aarti at dusk. Ban ALL loudspeakering of religion. https://twitter.com/sonunigam/status/853758848133242880 …
